1. Place and hours of business
DKN Immigration Law operates from Holloway Chambers, 27 Priory Street, Dudley, West Midlands DY1 1EJ and is regulated by the Immigration Advice Authority (IAA). Appointments are by arrangement. We may make appointments outside standard hours when essential to the interest of our clients, subject to the discretion of your Adviser.
2. People responsible for your work and time frame
The Caseworker responsible for your work will be listed on the Client Care Letter we will send to you, together with names of any other members of our team who may assist. We try hard not to change the persons acting for you but should this become necessary we will notify you of the change in writing.
We endeavour to complete work as soon as we receive your instructions with the necessary supporting documents. UKVI case working times can range from six weeks to six months or more depending on the type of your case. According to UKVI general guidelines, no follow-up is required until an application has been with them for over six months.
3. Charges, expenses and payments
We require you to settle the required fees with cleared funds before we close your case. We reserve the right not to carry out any further work unless the full agreed fee is settled. Refunds will only be made for work that has not been carried out, after adjusting for work that has been agreed and completed. Once you have agreed and paid our fees and had your case closed, under no circumstances can these fees be refunded. We work strictly on a mutually agreed fixed-fee basis before we commence any work on your behalf.
From time to time we may need to incur disbursements on your behalf (for example photocopying, interpreter or translation fees, agent fees, travel, courier or international postage). Additional charges will be notified to you in writing in advance for your consent. All UK postage is included in our quoted fees; out-of-country postage and courier costs are payable by the client.
We do not undertake publicly funded work via Legal Aid. If you believe you may be eligible for public funding we recommend you contact Legal Aid guidance services, or we can refer you to a firm that does.
4. Payments on account for disbursements
It is normal practice to ask clients to make payments on account from time to time to meet expected disbursements and avoid delaying progress. Your consent for the payment of disbursements will be sought before such fees are incurred. If the matter does not proceed to conclusion you will still need to pay for disbursements that have arisen.
5. Service levels and your responsibilities
We will update you on a regular basis as the matter proceeds via letter, email, SMS, phone or other appropriate channels. We will review your matter regularly and advise you of relevant changes in the law or risks of which we are aware. We require you to provide clear, timely and accurate instructions and all documentation required to complete the matter in a timely manner.
6. Referrals
As a regulated adviser we cannot accept any referral fee from any person for recommending or referring a client, and we cannot offer or accept an inducement for taking on a client. Where a conflict of interests arises, we may have to stop acting for both parties.
7. General

8. Data protection & privacy
We use the information you provide primarily for the provision of immigration services and related purposes. Our use of that information is subject to your instructions, UK data protection law and our duty of confidentiality. 9. Your right to cancel
After you have made payment, by signing and returning our client care letter you may waive your right to cancel the contract before the expiry of seven days, as set out in that letter. Specific cancellation and administration charges (if any) will be confirmed in your Client Care Letter.
10. Complaints
If you have a complaint, please speak first to a member of staff in the area where the problem took place. Most complaints are resolved this way. We endeavour to resolve complaints within 5 working days, or acknowledge within 2 working days and respond fully within 20 working days.
If you are not happy with the result or handling of your complaint you can contact the Immigration Advice Authority (IAA) / Office of the Immigration Services Commissioner (OISC) helpline on 0345 000 0046 or email info@oisc.gov.uk.
11. Termination
We may terminate instructions if we feel that you have made false representations or provided false documents. We will give reasonable notice and notify you in writing within 3 working days of termination. Administration charges for early termination before formal instruction (if applicable) will be set out in your Client Care Letter.
12. Storage of papers and documents
After completing the work, we are entitled to keep all your papers and documents while there is money owing to us. We will keep your file for six years, after which we may destroy it or charge for continued storage with prior notice. You authorise us to store the file electronically. Retrieval of stored papers for new or continuing instructions is normally free; producing papers to you or another professional at your request may be charged as set out in our Client Care Letter.
13. Change in immigration law
We shall not be held liable for advice if the law on immigration regarding your matter changes subsequently. We will endeavour to advise you of any law changes as soon as we are made aware, however a change brought into force once your application has been completed will not render us liable for any refusal which you may receive as a result.
14. Limitation of liability
Our liability to you is limited in every case to the amount of the fees paid to us for performing our service. We will not be liable for consequential, special, indirect or exemplary damages, costs or losses attributable to lost profits or opportunities. Once we have completed and lodged your application, we will not be held liable for delays caused by you in providing documents, or for a refusal by the Home Office or other adjudicating body.
15. Professional indemnity insurance
DKN Immigration Law has professional indemnity insurance.
16. Use of this website

17. Governing law

Your continuing instructions will amount to your acceptance of these terms of business. Please sign and return any Client Care Letter sent to you so we can be confident that you understand the basis on which we act for you.
